When you use Hitfactor, you're agreeing to these Terms of Service ("Terms"). If you violate these terms, we may terminate your account.
We may update these Terms from time to time. If we make significant changes, we'll email you.
Definitions
"We", "our", or "us" refers to Hitfactor, Inc.
"Service" refers to our website at hitfactorapp.com and the Hitfactor application, whether delivered within a web browser, desktop application, or mobile application.
"You" or "your" refers to the people or organizations that own an account with Hitfactor.
Account Terms
- You're responsible for maintaining the security of your account and password. We can't be liable for any loss or damage from your failure to keep your account secure. We recommend using two-factor authentication.
- You're responsible for all content posted to and activity that occurs under your account.
- You must be a human. Accounts registered by "bots" or other automated methods are not permitted.
Payment, Refunds, and Plan Changes
- If you're using a free trial, we'll tell you how long it lasts when you sign up. After the trial, you need to pay in advance to keep using Hitfactor. If you don't pay, we'll freeze your account until you make payment.
- When upgrading from free to paid, we'll charge your card immediately and your billing cycle starts that day. For other plan changes, the new rate starts from the next billing cycle.
- All fees are exclusive of taxes. Where required, we'll collect taxes on behalf of the taxing authority. Otherwise, you're responsible for payment of all taxes.
- We process refunds according to our Refund Policy: We offer a 30-day money-back guarantee. If you're not satisfied within your first 30 days, we'll refund your payment. After 30 days, no refunds are offered, but you can cancel anytime.
Cancellation and Termination
- You're solely responsible for properly canceling your account. You can cancel from your account settings. An email request to cancel is not considered cancellation.
- All of your content will be inaccessible immediately upon cancellation. Within 60 days, all content will be permanently deleted. We cannot recover this information once it's deleted.
- If you cancel before the end of your current paid month, your cancellation takes effect immediately, and you won't be charged again. We don't prorate unused time.
- We reserve the right to suspend or terminate your account for any reason at any time.
- Verbal, physical, written or other abuse (including threats of abuse or retribution) of our team will result in immediate account termination.
Modifications to the Service and Prices
- We intend to keep Hitfactor running for as long as possible. Sometimes we need to modify or discontinue features. We reserve the right to do so with or without notice.
- If we change our pricing, we'll give existing customers at least 30 days notice via email.
Uptime, Security, and Privacy
- Your use of Hitfactor is at your sole risk. We provide the Service on an "as is" and "as available" basis. We don't offer service-level agreements, but we do take uptime seriously.
- We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other customers.
- We take many measures to protect and secure your data through backups, redundancies, and encryption.
- You agree that we may process your data as described in our Privacy Policy and for no other purpose.
We may access your account only:
- To help you with support requests you make (with your consent)
- When an error occurs that stops an automated process
- To safeguard Hitfactor and investigate abuse
- To the extent required by applicable law
We use third party vendors (AWS, Stripe, PostHog, Google) to provide the technology required to run the Service.
Copyright and Content Ownership
- All content posted on Hitfactor must comply with U.S. copyright law.
- You give us a limited license to use the content you post only to provide the Service to you. We claim no ownership rights over your materials. Everything you submit remains yours.
- We don't pre-screen content, but reserve the right to refuse or remove any content at our sole discretion.
- We own all right, title, and interest in and to the Service itself, including all intellectual property rights. You may not duplicate, copy, or reuse any portion of our HTML, CSS, JavaScript, or visual design elements without express written permission.
YouTube and Third-Party Platforms
- Hitfactor helps you analyze and create content for YouTube. You're responsible for ensuring your use of our Service complies with YouTube's Terms of Service and Community Guidelines.
- We're not affiliated with YouTube or Google. We can't guarantee that strategies or content created with Hitfactor will achieve specific results on YouTube.
- You're responsible for all content you publish to YouTube or any other platform using materials created with Hitfactor.
Liability
We're not liable for any damages that result from your use of Hitfactor. This includes but isn't limited to:
- Loss of data, profits, or business
- YouTube channel performance or metrics
- Actions taken by YouTube or other platforms
- Content created using our Service
- Inability to access your data
Your use of Hitfactor is at your own risk.
California Specifics
Under the California Consumer Privacy Act ("CCPA"), we're a "service provider", not a "business" or "third party". That means we process your data only for the purpose you signed up for and as described in these Terms and our Privacy Policy. We don't retain, use, disclose, or sell that information for any other commercial purposes.
The Bottom Line
We'll do our best to provide a great service and treat you fairly. You agree to use Hitfactor responsibly and legally. If something goes wrong, we'll try to fix it, but we can't be held liable for damages.
